Welcome to See The Bravo. These Terms of Service ("Terms") govern your access to and use of the See The Bravo website, mobile applications, VisionOS applications, and any related services (collectively, the "Services") provided by DreamingWell LLC ("Company," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Acceptance of Terms

By creating an account, downloading our applications, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. License and Restrictions

2.1 Limited License

Subject to your compliance with these Terms, DreamingWell LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use only.

2.2 Restrictions on Distribution and Resale

You expressly agree that you will NOT:

• Distribute, sublicense, lease, rent, loan, or otherwise transfer the Services or any applications to any third party
• Resell, redistribute, or commercially exploit the Services or any applications in any manner
• Make the Services or any applications available to multiple users through any means, including but not limited to uploading to a network or file-sharing service
• Copy, reproduce, or duplicate the Services or any applications except as expressly permitted
• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Services or any applications
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Services or any applications
• Use the Services or any applications to develop a competing product or service
• Share your account credentials or allow others to access the Services through your account

Any unauthorized distribution, resale, or transfer of the Services or applications is strictly prohibited and may result in immediate termination of your license and legal action.

3. Prohibited Uses

3.1 Flight Operations Prohibition

You expressly agree that you will NOT use the Services, or any information, data, or content obtained through the Services, for any of the following purposes:

• Planning any flight, whether visual flight rules (VFR) or instrument flight rules (IFR)
• Making any operational decisions related to the conduct of a flight
• Determining weather conditions for flight planning or in-flight decisions
• Assessing airspace restrictions, temporary flight restrictions (TFRs), or NOTAMs
• Navigation or position determination during any phase of flight
• Fuel planning or weight and balance calculations
• Any purpose that would affect the safety of flight operations
• Any use as a primary or backup source of aviation information during flight

3.2 General Prohibited Uses

You further agree not to:

• Use the Services in any manner that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Services
• Interfere with or disrupt the Services or servers connected to the Services
• Reproduce, duplicate, copy, sell, or resell any portion of the Services
• Use the Services to transmit any harmful code or malicious software
• Scrape, harvest, or collect data from the Services using automated means
• Use the Services to infringe upon the intellectual property rights of others

4. Information Sources and Accuracy

4.1 Third-Party Data Sources

The Services may display information obtained from various third-party sources, including but not limited to:

• Federal Aviation Administration (FAA)
• ADSB.lol
• National Weather Service (NWS)
• Other aviation data providers and aggregators

4.2 No Guarantee of Accuracy

You acknowledge and agree that:

• Information may not reflect current real-world conditions
• Data feeds may experience delays, interruptions, or failures
• Visualizations and displays are approximations and may contain errors
• Weather information may not be current or accurate for any specific location
• Airspace depictions may not reflect current restrictions or boundaries
• Traffic information may be incomplete, delayed, or inaccurate

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

DreamingWell LLC expressly disclaims all warranties, including but not limited to:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF ANY INFORMATION
• UNINTERRUPTED OR ERROR-FREE OPERATION
• THAT DEFECTS WILL BE CORRECTED
• THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS

We do not warrant that the Services will meet your requirements or expectations, or that any information obtained through the Services will be accurate, reliable, or suitable for any purpose whatsoever.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DREAMINGWELL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• PERSONAL INJURY OR PROPERTY DAMAGE
• DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES
• DAMAGES ARISING FROM ANY INFORMATION OBTAINED THROUGH THE SERVICES
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
• DAMAGES ARISING FROM ANY THIRD-PARTY CONTENT OR CONDUCT

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless DreamingWell LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of any third party
• Any use of information obtained through the Services for flight planning or operations
• Any claim that your use of the Services caused damage to a third party
• Any unauthorized distribution or resale of the Services or applications

8. Assumption of Risk

You expressly acknowledge and agree that your use of the Services is at your sole risk. You assume full responsibility for any decisions you make based on information obtained through the Services. You understand that aviation activities involve inherent risks, and you agree that DreamingWell LLC shall not be liable for any damages or injuries arising from aviation activities, regardless of whether information from the Services was involved.

9. Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof, are owned by DreamingWell LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

11. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease, and you must destroy all copies of any applications or materials obtained from the Services.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DreamingWell LLC regarding the Services and supersede all prior agreements and understandings.
